Here's a breakdown of the Realvolve Terms of Use, but in a more chill, easy-to-understand way:

Account Stuff

Who can use Realvolve?
You need to be at least 18, fill out the registration, agree to these terms, and give us your real info. No robots allowed for accounts!

One login per person: Your login is just for you. If other people need access, they need their own logins (up to what your plan allows).

Keep your password safe: You're responsible for your account's security. We can't help if your password gets stolen or hacked, and we can only reset your password, not tell you what it is.

You're responsible for your account's activity: Anything that happens on your account, even if someone else under your account posts it, is on you.

No multiple trial accounts: Just one trial account per person or company.

Don't do anything illegal: No using Realvolve for anything against the law.

How long does this agreement last? As long as you're using Realvolve. Clicking that button and putting in your username means you agree to all this.

If you sign up for a company: You're saying you have the authority to agree to these terms for them.

Want to cancel? Give us a heads-up 30 days before your next renewal.

We can suspend your service: We can do this anytime, for any reason or no reason.

Inactive accounts get deleted: If you don't log in for a year or more, we might delete your account and all your data (contacts, listings, emails, etc.).

Changes to these terms: We might change these terms. We'll post the new ones on our website or email you. If you don't cancel within 10 days, the new terms are effective immediately.

Billing: You need a valid credit card. We bill in advance, and there are no refunds for partial months, upgrades/downgrades, or unused months if your account is open. Taxes are on you, except for US federal/state taxes.

Upgrades/Downgrades: Your card will automatically be charged the new rate. Be aware that downgrading might mean losing some features or data. We're not responsible for that loss.

Your Rights & Our Rights

Our stuff is ours:
All the cool design, code, and software for Realvolve belongs to us. Don't copy or reuse it without our permission.

Your stuff is yours: The emails, documents, and files you upload belong to you. We'll only use or share them as outlined in these terms and our Privacy Policy.

Privacy Policy: You agree to our Privacy Policy, which is part of these terms.

We can peek at your messages: We might look at your emails, Facebook, Twitter, and SMS messages (the ones sent through our service) to develop tools that help us catch problem accounts or people breaking the rules.

Rules & No-Nos

No Spam!
Seriously, don't send spam. We go by the Spamhaus definition.

No shady lists: Don't use purchased, rented, or third-party lists.

Follow our Acceptable Use Policy: It's part of this agreement too.

Use at your own risk: Realvolve is provided "as is."

Tech support: Only for paying customers, and only via email.

Third-party vendors: We use them for hosting and other tech stuff.

Don't mess with our service: No modifying, hacking, or trying to make another website look like it's ours.

Don't rip us off: No reproducing, selling, or exploiting any part of Realvolve without our written permission.

We can remove bad content/accounts: If something's offensive, illegal, or violates our terms, we can take it down.

Be nice: Any abuse of our customers, employees, or officers will get your account terminated immediately.

Unencrypted data: Your content might be transferred unencrypted and adapt to technical requirements.

No worms or viruses: Don't upload destructive code.

Bandwidth limits: If you use over 500 MB/month or way more than the average user, we might disable your account or slow down your file hosting until you cut back.

No guarantees: We don't promise that the service will meet your needs, be error-free, always available, or that the results will be perfect. We also don't promise to fix every bug.

Limited liability: We're not responsible for any indirect, special, or consequential damages, even if we know they might happen. This includes lost profits, data, or problems from using or not being able to use the service.

Not taking immediate action doesn't mean we're waiving our rights: If we don't jump on a violation right away, it doesn't mean we can't do something about it later.

Entire agreement: These Terms are the whole deal between you and Realvolve, replacing any previous agreements.

Bandwidth for Realvolve emails only: We can throttle your sending if needed.

Follow the laws: You're responsible for making sure your use of Realvolve complies with all applicable laws and regulations (HIPAA, GLB, EU Data Privacy, etc.).

EEA folks (European Economic Area): If you're in the EEA or sending to people there, you promise to clearly explain how you'll use their data, get their consent to transfer it to Realvolve, and follow all relevant privacy and data protection laws. You also agree to protect us from any losses if you break these promises.

Export Controls:
Our software is subject to US export laws, so don't download or re-export it illegally. You use it at your own risk.

See something, say something: If you notice anyone violating these terms, let us know immediately.

Liability Stuff

You're responsible for your use:
You take full responsibility for any loss from using our website and services.

No warranties: We provide everything "as is," without any warranties about merchantability or fitness for a particular purpose.

You'll protect us: You agree to cover our losses (including attorney fees) if you make claims that aren't allowed under these terms, or if someone using your password violates these terms.

Attorney fees: If we win a lawsuit against you for breaking these terms, you'll pay our reasonable attorney fees.

We're not responsible for others: This includes advertisers, linked websites, or other members.

Injunctive relief: If you break these terms, we can ask a court to stop you.

Subpoena fees: If we have to provide information about your account due to a subpoena, we might charge you for our costs.

The Fine Print

US Government Users:
Our software is "Commercial Items" and is licensed to you with the same rights as other users, according to these terms.

No assigning your rights: You can't transfer your rights under this agreement to anyone else, but we can assign ours.

Governing Law: Delaware laws apply to any disputes.

Stuff beyond our control (Force Majeure): We're not responsible for delays or failures caused by things like natural disasters, war, blackouts, or even a zombie apocalypse.

What sticks around if this agreement ends: Some sections, like proprietary rights, compliance with laws, liability limitations, and indemnity, will still apply.

If a section isn't enforceable: We'll remove or edit it minimally, and the rest of the terms will still be valid.

Headers and side text are just for reading: They don't change how the agreement is interpreted.

No individual changes to terms: Because we have so many members, we can't make special deals on the terms for anyone.

You'll take necessary actions: You'll do what's needed to meet your obligations.

Security Breach Notification: If there's a security breach affecting you or your email lists, we'll tell you what happened and if you need to inform anyone on your lists.

Notices: We'll send notices to your last email/physical address. You can send notices to our legal counsel at the provided address.

Examples of communication: We might contact you to promote services, bill you, send system alerts, enforce terms, provide support, protect rights, meet legal requirements, improve services, or for informational reasons about your account. We might also transfer your info if the company is sold. We can also send promotional content if you opt-in (you can unsubscribe anytime).

Subpoenas: We might have to disclose customer info to meet legal requirements, like for third-party disputes. We'll decide whether to comply based on the subpoena.

Public Information: Anything you post on our blog is public. Social media widgets on our site are governed by the privacy policies of those companies. Links to other websites also have their own privacy policies.

Email isn't private: Email isn't meant for confidential info, so don't send sensitive stuff through Realvolve. Server admins can read what you send.

We review email campaigns: We sometimes look at your email content to make sure it follows our terms, which helps reduce spam and improve deliverability for everyone.

Confidentiality rule of thumb: "Never send anything in an email that you wouldn't put on a postcard."

Your contact lists are private: We store them securely and will never sell, contact, market to, or share your lists with anyone unless legally required. Only authorized employees can view them. You can export your lists anytime. We won't use your list info for billing, system alerts, account communication, or promotional content.

Your data is yours: We respect your and your subscribers' privacy. We don't sell your info or bother anyone on your list. While we own the Realvolve app, you own your data.

SecurityBreach Notification: If there's a security breach that significantly affects you or your lists, we'll notify you ASAP and tell you what we did about it.

Keeping your info safe: We use 128-bit SSL for credit card transactions, and our vendor is certified compliant with security initiatives. Your account passwords are encrypted (we can't see them, only reset them).

Vulnerability Disclosure Policy: If you find any bugs or vulnerabilities, please email security@realvolve.com. Our security team will respond within 24 hours.

ComplianceSafe Harbor Certification: We comply with US-EU and US-Swiss Safe Harbor Frameworks for personal data from EU/Switzerland, following principles like notice, choice, security, and enforcement.

Accurate data, transparency, and choice: We try to keep your data accurate, and it's up to you to tell us about changes. We only store data as long as needed, but some data (like email sending info) is kept indefinitely to fight spam. You can request access to your personal info within 30 days by emailing support@realvolve.com, and we'll remove it if not prohibited by law.

Enforcement: We and TRUSTe review our Privacy Policy compliance. We'll respond to written complaints and work with TRUSTe to resolve issues we can't settle directly with members.
